1. Acceptance of Terms
By booking, boarding, purchasing, or using a service provided by TOURA LLC (“TOURA,” “we,” “our,” or “us”), you agree to these Terms & Conditions and acknowledge that you have read and understood the applicable Passenger Agreement and Liability Waiver.
If you do not agree to these Terms & Conditions, do not use TOURA’s services.
Participation in TOURA’s text messaging program requires separate consent as described in Section 19. Merely using TOURA’s website or services does not constitute blanket consent to receive text messages.
2. Nature of Services
TOURA may provide:
- On-demand transportation
- Prearranged and scheduled transportation
- Airport transportation
- Scheduled tours
- Event and nightlife transportation
- Guided experiences
- Recreational equipment transportation
- Recreational vehicle transportation, including side-by-side vehicles where applicable
- Other transportation and travel-related services
TOURA may provide services through employees, independent contractors, guides, and third-party drivers or transportation providers.
Service availability may depend on location, scheduling, weather, vehicle availability, driver availability, and applicable legal or regulatory requirements.
3. Assumption of Risk
Passengers acknowledge that transportation, tours, recreational activities, and outdoor activities involve inherent risks, including but not limited to:
- Vehicle accidents
- Road hazards
- Adverse weather conditions
- Mechanical failure
- Acts or negligence of other motorists
- Passenger behavior
- Outdoor terrain conditions
- Wildlife
- Water-related hazards
- Off-road or side-by-side vehicle use
- Delays or interruptions beyond TOURA’s reasonable control
By voluntarily participating in TOURA services, passengers acknowledge and assume the ordinary and inherent risks associated with the applicable transportation, tour, or recreational activity to the extent permitted by law.
Nothing in these Terms is intended to waive a right or remedy that cannot legally be waived.
4. Release of Liability
To the fullest extent permitted by applicable law, passengers agree to release, waive, and discharge TOURA LLC and its owners, officers, employees, contractors, drivers, guides, representatives, and affiliates from liability arising from the ordinary and inherent risks of transportation, tour, and recreational activities.
This provision may apply to claims involving personal injury, property damage, emotional distress, incidental damages, and indirect or consequential damages.
This release does not apply to liability that cannot legally be waived, including liability resulting from gross negligence, reckless misconduct, or willful misconduct where applicable.
5. Seatbelts and Safety Compliance
Passengers agree to:
- Wear seatbelts whenever required or available
- Properly secure children in legally required safety seats
- Follow reasonable driver and guide safety instructions
- Remain seated while a vehicle is moving
- Avoid distracting or interfering with the driver
- Refrain from opening vehicle doors while the vehicle is moving
- Use recreational equipment in a safe and lawful manner
Passengers are responsible for providing any legally required child safety seat unless TOURA expressly agrees otherwise.
Failure to follow safety instructions may result in refusal or termination of service without a refund, subject to applicable law.
6. Passenger Conduct
Passengers must not:
- Engage in illegal activity
- Threaten, harass, or assault a driver, guide, employee, contractor, or another passenger
- Damage or improperly use vehicle or company property
- Carry illegal drugs, weapons, or prohibited materials
- Bring open containers of alcohol where prohibited
- Smoke or vape inside a vehicle unless expressly permitted
- Interfere with the safe operation of a vehicle
- Create an unreasonable health or safety risk
- Provide false or misleading booking information
TOURA reserves the right to refuse, suspend, or terminate service when reasonably necessary to protect passengers, drivers, guides, the public, or company property.
Passengers may be financially responsible for damage, cleaning costs, losses, or expenses caused by their conduct.
7. Alcohol and Nightlife Transportation
Passengers using nightlife or entertainment transportation services acknowledge that:
- Drivers may refuse service to individuals who present a safety risk.
- Open containers are prohibited unless expressly permitted by applicable law.
- Illegal drug use and unlawful conduct are prohibited.
- TOURA does not provide or supervise alcohol consumption unless expressly stated.
- Passengers remain responsible for their conduct before, during, and after transportation.
- TOURA may contact law enforcement or emergency medical services when reasonably necessary for safety.
TOURA does not guarantee transportation to any individual whose condition or conduct could endanger the driver, other passengers, or the public.
8. Property Damage and Cleaning Fees
Passengers may be responsible for reasonable costs resulting from damage to a vehicle or equipment, excessive cleaning, spills or stains, bodily fluids, smoking or vaping inside a vehicle, lost or damaged equipment, repair costs caused by passenger misconduct, and downtime reasonably resulting from passenger-caused damage.
TOURA may charge an authorized payment method for applicable damage or cleaning costs when permitted by law and disclosed to the passenger.
Passengers may request documentation supporting an assessed charge.
9. Recording and Monitoring Disclosure
For safety, security, dispatch, insurance, and legal purposes, TOURA vehicles or services may use GPS tracking, route and location monitoring, exterior dash cameras, interior video recording, and audio recording where legally permitted.
Recordings or location information may be used for passenger and driver safety, dispatch operations, incident investigation, insurance claims, legal compliance, dispute resolution, and fraud prevention.
Recording will be conducted only where permitted by applicable law. Additional notice or consent will be obtained when legally required.
By entering a clearly identified TOURA vehicle after receiving legally required notice, passengers acknowledge that authorized recording or monitoring may occur.
10. Limitation of Liability
To the fullest extent permitted by law, TOURA will not be liable for lost profits, lost business opportunities, indirect or consequential damages, incidental damages, punitive damages, delays caused by circumstances outside TOURA’s reasonable control, or items lost, forgotten, or left inside a vehicle.
Where permitted by law, TOURA’s maximum contractual liability for a claim arising from a specific service will not exceed the amount paid for that ride, tour, or service.
These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
11. Independent Contractors and Third-Party Providers
Some services may be performed by independent contractors, guides, third-party drivers, or other transportation providers.
Drivers and providers are responsible for maintaining legally required licenses, operating vehicles in accordance with applicable law, following applicable safety requirements, and maintaining required insurance where applicable.
Nothing in this section eliminates any responsibility TOURA may have under applicable law.
12. Insurance Disclosure
TOURA maintains insurance coverage as required by applicable law.
Insurance coverage, limits, exclusions, and applicability may vary depending on vehicle type, driver or provider status, nature and location of the service, operational status at the time of an incident, and applicable insurance policy terms.
Insurance coverage does not eliminate the ordinary and inherent risks associated with transportation or recreational activities.
13. Weather, Delays, and Force Majeure
TOURA is not responsible for delays, cancellations, route changes, or service interruptions caused by circumstances outside its reasonable control, including severe weather, unsafe road conditions, road closures, traffic congestion, vehicle accidents, government actions, public emergencies, mechanical breakdowns, natural disasters, utility or communications failures, labor disruptions, and acts of third parties.
TOURA may delay, reroute, reschedule, or cancel a service when reasonably necessary for safety or because performance has become impracticable.
When appropriate, TOURA will make reasonable efforts to notify affected customers and offer available alternatives.
14. Cancellations and Refunds
Cancellation and refund terms may vary depending on the type of ride, tour, rental, event, or other service booked.
Applicable cancellation terms should be presented during booking or included in the customer’s confirmation.
Refunds may be reduced or denied for late cancellations, passenger no-shows, failure to arrive at the agreed pickup location, unsafe or unlawful passenger conduct, services already performed, or nonrefundable third-party expenses incurred for the booking.
Nothing in this section limits refund rights required by applicable law.
15. Indemnification
To the fullest extent permitted by law, passengers agree to indemnify and hold harmless TOURA LLC and its owners, officers, employees, contractors, drivers, guides, and representatives from third-party claims, damages, or expenses resulting from passenger misconduct, passenger violation of applicable law, property damage or injury caused by the passenger, fraudulent activity, false or misleading claims, or unauthorized or unsafe use of equipment.
This provision does not require a passenger to indemnify TOURA for TOURA’s gross negligence, reckless misconduct, or willful misconduct.
16. Governing Law and Disputes
These Terms & Conditions are governed by the laws of the State of Idaho, without regard to conflict-of-law principles.
To the extent legally permitted, disputes arising from these Terms or TOURA’s services will be resolved in a court of competent jurisdiction located in Idaho.
Nothing in this section prevents a party from pursuing a claim in another jurisdiction when applicable law requires otherwise.
17. Severability
If any provision of these Terms & Conditions is found invalid, illegal, or unenforceable, that provision will be enforced to the greatest extent legally permissible. The remaining provisions will remain in effect.
18. Entire Agreement
These Terms & Conditions, together with any booking-specific terms, cancellation policy, Privacy Policy, and other agreements expressly presented to the customer, constitute the agreement between the passenger and TOURA concerning the applicable services.
If a booking-specific written agreement conflicts with these general Terms, the booking-specific agreement will control for that booking unless prohibited by law.
19. TOURA Text Messaging Program
19.1 Program Description
TOURA LLC offers a text messaging program for customers who separately provide consent to receive messages.
Messages may include booking confirmations, driver assignment and arrival notifications, pickup and drop-off updates, ride or tour status updates, schedule changes, cancellation notices, payment or account notifications, customer-support communications, and safety or emergency-related service notifications.
The program is intended primarily for transactional and customer-care communications connected to services requested by the customer.
TOURA will send messages only concerning the subjects for which the customer provided consent. Providing a telephone number by itself does not constitute blanket consent to receive text messages.
19.2 SMS Consent
By affirmatively opting into the TOURA text messaging program, you authorize TOURA LLC to send text messages to the mobile telephone number you provided.
Your consent applies only to TOURA LLC and the messaging purposes disclosed when you opt in.
SMS consent is voluntary. Consent to receive marketing or promotional text messages is not a condition of purchasing or using TOURA’s services.
If text messaging is necessary to provide a particular optional feature, TOURA will disclose that requirement before enrollment. Alternative communication methods may be available by contacting TOURA.
TOURA maintains records of SMS consent, including the date, time, method, and consent disclosure presented at the time of enrollment.
19.3 Promotional Messages
The standard TOURA customer-notification program is intended for transactional and customer-care messages.
If TOURA offers marketing or promotional text messages in the future, TOURA will request separate express written consent where required. Consent to transactional messages does not automatically authorize unrelated marketing messages.
19.4 Message Frequency
Message frequency varies based on the number of bookings made, ride or tour activity, schedule changes, account activity, customer-support requests, and safety or service-related events. TOURA does not guarantee that a particular number of messages will be sent.
19.5 Message and Data Rates
Message and data rates may apply. Charges are determined by your wireless carrier and mobile service plan. TOURA is not responsible for charges imposed by your carrier.
19.6 Opt-Out Instructions
You may stop receiving text messages from TOURA at any time by replying STOP to a TOURA message.
The opt-out process requires only one step. After replying STOP, you may receive one final message confirming that your opt-out request has been processed.
After you opt out, TOURA will not send additional text messages through that messaging program unless you provide consent again, you initiate a new text conversation to which TOURA is permitted to respond, or a message is otherwise permitted or required by applicable law.
Opting out of text messages does not cancel an existing ride, tour, reservation, payment obligation, or other service. Contact TOURA directly if you also wish to change or cancel a booking.
19.7 Customer Support and HELP
For assistance with the TOURA text messaging program, reply HELP to a TOURA text message, email avasquez@toura.id, or visit https://toura.id.
TOURA’s HELP response should identify TOURA LLC and provide customer-care or opt-out information.
19.8 Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
Message delivery depends on wireless-network availability, carrier systems, device compatibility, and other factors outside TOURA’s control. Delivery is not guaranteed. Not all mobile devices or wireless carriers may support every message or feature.
19.9 Sender Identification and Initial Message
TOURA will identify itself as the sender of its text messages except when identification is already clear during an ongoing conversation.
The initial automated message sent after enrollment will identify TOURA LLC and include instructions stating that the recipient may reply STOP to unsubscribe.
19.10 Privacy and Mobile Information
TOURA handles personal information and mobile information according to the Privacy Policy below.
TOURA does not sell or rent personal information.
Mobile information, telephone numbers, SMS opt-in data, and text-messaging consent will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes.
TOURA may disclose mobile information to service providers that assist with operating the messaging program, including telecommunications carriers and messaging-platform providers such as Twilio. These providers may use the information only to provide services to TOURA and may not use it for their independent marketing or promotional purposes.
19.11 Re-Enrolling in Text Messages
After opting out, you may re-enroll only by providing new consent through an authorized TOURA enrollment process or by using an authorized opt-in keyword when available.
Consent is not transferred between individuals, telephone numbers, businesses, affiliates, or unrelated messaging programs.
19.12 Changes to the Messaging Program
TOURA may modify or discontinue its text messaging program, subject to applicable law.
If a material change affects the type or subject matter of messages being sent, TOURA may request new or renewed consent before sending messages under the changed program.
20. Privacy Policy
TOURA’s collection, use, retention, security, and disclosure of personal information are described in the Privacy Policy below. The Privacy Policy is incorporated into these Terms by reference.
21. Changes to These Terms
TOURA may update these Terms & Conditions periodically.
Updated terms will be posted on this page with a revised effective date. Changes to the text messaging program remain subject to applicable consent requirements.
The terms applicable to a particular transaction will generally be the terms in effect when the transaction occurred, unless applicable law provides otherwise.

1. Introduction
TOURA LLC (“TOURA,” “we,” “our,” or “us”) provides transportation services, ride booking, tours, and related travel experiences through our website and mobile applications.

3. How We Use Information

4. SMS Communications and Consent
TOURA LLC may send text messages only to individuals who have provided appropriate consent or who have initiated a text-message conversation with TOURA.
Depending on the services requested and the consent provided, messages may include booking confirmations, driver assignment and arrival notifications, pickup and drop-off updates, ride or tour status updates, payment or account notifications, customer-support communications, and emergency or safety-related service notifications.
Message frequency varies depending on your bookings, account activity, and interactions with TOURA. Message and data rates may apply.

By entering a TOURA vehicle, passengers acknowledge recording may occur.
7. Passenger Conduct and Liability Acknowledgement
Passengers agree to follow driver safety instructions, use seatbelts when available, and avoid unsafe behavior.
TOURA LLC reserves the right to refuse service where safety concerns exist. Damage caused by passengers may result in additional charges.
8. Photography and Promotional Media
Tours and rides may occasionally involve photography or video recording for marketing, social media promotion, and website content.
If identifiable images are used publicly, reasonable efforts will be made to respect customer privacy. Customers may request removal of identifiable promotional material when feasible.
9. Alcohol and Nightlife Transportation
Passengers using nightlife or entertainment transportation services remain responsible for lawful behavior. Drivers may refuse service to individuals who present a safety risk. TOURA LLC complies with local and state transportation laws.
10. Third-Party Services
We may rely on third-party providers including Google Maps, Apple Maps, Square payment services, WooCommerce, SMS notification providers, and cloud hosting platforms. These providers maintain independent privacy policies.
11. Data Sharing
TOURA LLC does not sell or rent personal information.
We may disclose information when reasonably necessary to complete rides, tours, or other requested services; process payments; operate booking, dispatch, mapping, hosting, and communications systems; work with assigned drivers or guides; handle insurance claims or safety incidents; or comply with applicable legal or regulatory requirements.
Service providers may receive only the information reasonably necessary to perform services on TOURA’s behalf and may not use that information for their independent marketing purposes.
Mobile information, SMS opt-in data, and text-messaging consent will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.
12. Data Security
We implement reasonable protections including SSL encryption, secure hosting, and restricted administrative access. No online system guarantees absolute security.
13. Data Retention
Information is retained only as long as necessary to complete services, maintain accounting records, and meet insurance or legal obligations.

Services are not intended for persons under 18 without adult supervision. We do not knowingly collect information from minors.
